1. General points

1.1 The General Terms and Conditions (GTC) regulate all services and business relationships between Rocket Games AG (rocket-games.ch) and their customers.

2nd offer

2.1 The offer of rocket-games.ch is aimed at:

  • customers 18 yearswho are legally competent.
  • Persons residing in Switzerland, the Principality of Liechtenstein or the EU.

2.2 The offer is non-binding. A purchase contract is only created by:

  • shipping confirmation or
  • Confirmation of readiness for collection.

Rocket Games reserves the right:

  • To refuse orders exceeding normal household quantities.
  • To cancel orders despite order confirmation if items are not available.

3. Order and delivery

3.1 Orders are possible:

Cancellations will occur if an item is not available. No claims for compensation can be made.

3.2 Delivery times:

  • Delivery times are non-binding and serve only as a guide.
  • In case of delivery delays of more than 14 days, the customer can withdraw from the contract after written notification.
  • No right of withdrawal for individually configured controllers.

3.3 Partial deliveries:
Rocket Games is entitled to deliver orders in parts. Cancellation of the entire order is not possible in the case of partial deliveries.

3.4 Delivery conditions:

  • Delivery is available to Switzerland, Germany, Austria, Liechtenstein and the EU.
  • Delivery takes place to the curb/mail box.
  • Optionally, a paid transport guarantee which covers transport damage.

3.5 Pick-up service is offered.

3.6 The Customer must:

  • Delivered goods immediately on accuracy, completeness and integrity check.
  • Damages within 5 days report after delivery.

In case of complaints:

  • Keep the original packaging.
  • Packaging may only be disposed of after written consent has been obtained.

4. Prices

4.1 Rocket Games reserves the right to change prices at any time. The price published at the time of the order applies. Later changes are not retroactive.

4.2 Prices and tax regulations:

  • All prices within Switzerland and the European Union (EU) include value added tax (VAT).
  • Outside the EU, prices are quoted without VAT.
    Note: For deliveries outside the EU, additional import duties, taxes and fees may apply, which must be borne by the customer.

4.3 Extra costs:

  • Shipping costs, transport guarantee and other additional costs are not included in the price and are shown separately.

4.4 Prices are subject to change, errors and misprints.

5. Payment and retention of title

5.1 Payment method:
The available payment methods are indicated on the website. Rocket Games reserves the right:

  • Exclude payment methods generally or for individual customers.
  • to charge surcharges for certain payment methods.
  • To carry out credit checks and to forward data to third parties.

Invoice: Payment within 10 days without deduction. In the case of returns, the invoice amount will be adjusted after consultation.

5.2 Reminder fees:

  • 2nd and final reminder: CHF 20.- fee.
  • Unsuccessful dunning: Handover to debt collection agency with additional costs (up to 15% annual interest and processing fees).

5.3 Credit/Debit Card Payments:

  • Charges will be made upon ordering.
  • If you pay in advance, your order will only be processed after receipt of payment.

5.4 Retention of title:

  • Goods remain the property of Rocket Games until the full amount has been paid.

6. Returns, Cancellations, Warranty and Repairs

6.1 Returns:

  • No general right of return or exchange.
  • Returns only after written approval within 14 calendar days possible.
  • Conditions:
    • Goods must be unused, in their original packaging and complete.
    • Return at the customer's expense and risk.
  • Refunds will be made excluding shipping costs and deducted my purchase and refund fees (each at 3.8% PayPal fee).

6.2 Defective devices:

  • Defects must be reported to customer service.
  • Return will be made to own costs.
  • In the case of damage not covered by the guarantee (e.g. due to your own fault), a cost estimate will be prepared.

6.3 Warranty:

  • Minimum warranty for new devices: 2 years.
  • Warranty includes:
    • Repair or replacement by the manufacturer.
    • No liability for indirect or consequential damages.
  • Warranty excludes:
    • Mechanical damage, improper use, wearing parts e.g. original sticks.

7. Liability

Rocket Games is only liable for damages caused by intentional or grossly negligent actions. Liability for indirect damages and consequential damages resulting from the use, malfunction or failure of the product is excluded.

In addition, the following disclaimers apply:

  • Normal wear and tear: Damage caused by normal use, wear and/or aging, as well as defects resulting from these causes.
  • Intentional or negligent damage of the product by the user, such as improper use, dropping, throwing or other abusive handling.
  • Excessive or unreasonable use of the product, e.g. in the context of commercial use.
  • Use in unsuitable environments: Damage caused by contact with liquids, moisture or chemicals.
  • Manipulation or changes: This includes attempts to open, disassemble, modify, customize or repair the product yourself.
  • extreme conditions: Using the product under extreme temperatures or other exceptional conditions.
  • Faulty power supply: Damage caused by charging the product using unapproved outlets or power cords, faulty power cords, or cords that exceed the product's rated values.
  • Electrical damage: Damage caused by power surges, lightning strikes or other external power sources.
  • Cosmetic changes: Scratches, dents or other visual changes to the product compared to its original condition.

8. Data Protection

8.1 Principles:

  • Processing of personal data in accordance with Swiss Data Protection Act and EU GDPR.
  • Data security is guaranteed by hosting providers.

8.2 Data usage:

  • Data may be evaluated for marketing purposes.
  • Transfer to affiliated companies and advertising partners is possible.

8.3 Storage:

  • Data is used for 10 years stored.

10. Special provisions for modified controllers

10.1 Right of withdrawal:
No right of withdrawal for individually configured controllers.

10.2 Warranty scope:

  • Paint, buttons, digital triggers, digital bumpers: 2 years.
  • Drift on sticks original sticks: 90 days manufacturer warranty.
  • Hall Effect: 2 year warranty

10.3 Warranty Exclusions:

  • Damage caused by improper use (throwing, hitting, excessive pressure).
  • Manipulation or independent repair attempts.
  • Normal wear and tear and cosmetic damage.

10.4 Shipping and manufacturing:

  • Individually configured controllers: Shipping within 30 days of order confirmation.
  • Pre-configured controllers: Shipped within 30 days of order.
